1.1 This Privacy Statement explains how we collect, use, and protect your personal data. It also outlines your rights under the General Data Protection Regulation (GDPR) and the Dutch Data Protection Act (AVG).

2.1 The Data Controller is the controller responsible for the processing of your personal data:

Article 3 – Personal Data we Collect

3.1 We collect and process the following data you directly provide to us when you register online via our website and app, or offline in our gym and when you use our website via cookies or similar technologies:

  • Full name, date of birth, gender
  • Address, email address, phone number
  • Payment and billing details
  • For minors: name and contact details of parent/legal guardian
  • Training attendance and membership details

3.2 Certain personal data, such as contract and payment details, is required to fulfil the membership agreement.

Article 4 – Purpose and Legal Basis of Processing

4.1 Your personal data is processed for the following purposes:

  • Membership administration and communication
  • Payment processing and billing history
  • Class scheduling and attendance tracking
  • Sending service-related updates, class or event announcements, and other relevant communications

4.2 The legal bases are:

  • The performance of a contract (membership agreement)
  • Legal obligation (e.g., tax administration)
  • Legitimate interest (e.g., ensuring safety and communication efficiency)
  • Consent (e.g. for the use of analytical cookies via the cookie banner)

Article 5 – Data Sharing

5.1 We do not sell your personal data. We may share it with: 

  • The Payment provider (e.g., iDEAL, Mollie Payments)
  • Governmental authorities if legally required
  • Service providers operating under data processing agreements

Article 6 – Data Retention

6.1 We retain your personal data:

  • For active members: as long as the membership exists and up to 2 years after termination.
  • For financial records: 7 years in compliance with tax laws.

6.2 You may request earlier deletion, unless retention is required by law.

Article 7 – Your Data Protection Rights

7.1 You have the following rights:

  • Right to access your data
  • Right to correct inaccurate data
  • Right to request deletion (“right to be forgotten”)
  • Right to object or restrict to processing
  • Right to data portability (where applicable)

7.2 Certain rights may be limited if exercising them would prevent us from fulfilling the Agreement or complying with legal obligations. For example, deletion of data essential for billing, communication, or contract execution may result in termination of your membership. In some cases, we are legally required to retain specific information for a minimum retention period (e.g., for tax or financial administration purposes).

Article 8 – Media Use Notice

8.1 Photos and videos may regularly be taken during classes or events to highlight the spirit and activity of our Gym community. These media may be used for community building and promotional purposes, including our website and social media platforms. Where feasible, we will inform Members and Participants in advance when media is being recorded (e.g., signage or verbal notice). By accepting these General Terms and Conditions, the Member, Participant or Legal Guardian consents to the use of media in which they or their child might be clearly identifiable.

8.2 The Member, Participant or Legal Guardian has the right to refuse or withdraw this consent at any time. If you or your child, where clearly identifiable, prefer not to be included in media, written notice is required. We will respect your preference and ensure exclusion from all future media usage. Article 9 – Privacy Statement Updates

9.1 We keep the Privacy Statement under regular review and place any updates on our website and at our gym reception. Members will be informed of significant changes affecting your rights or use of personal data.

10.1 Cookies are text files placed on your device that help us understands how visitors interact with our website. We may collect certain information through cookies or similar technologies when you visit our website.  

10.2 We use cookies for the following purposes:

Article 13 – Automated Decision-Making and Profiling

13.1 We do not use any form of automated decision-making that has legal consequences or significantly affects individuals, such as decisions made without human involvement.

13.2 We may use tools such as Google Analytics to analyze aggregated website usage data and user interaction. This may involve limited profiling (e.g., tracking pages visited or devices used), but does not result in decisions about individuals. Use of such tools is governed by your cookie preferences, which can be managed via our cookie banner.
